Eugene Man Captured on Felony Driving Charges, Parole Violation Tied to Fatal 2017 Crash
Eugene, OR — Andrew D. Capps, 31, of Eugene, was arrested by the Oregon State Police on March 10, 2026, and booked into the Lane County Jail.
The arrest stems from a bench warrant issued in November 2025 after Capps failed to appear for a trial on a felony charge of driving while his license was suspended or revoked.
Capps faces the following charges:
That conviction stemmed from a December 30, 2017, crash on Bailey Hill Road in Eugene, where Capps was driving when his vehicle left the roadway and crashed. Passenger Mack Wallace Carothers, 24, was ejected and died at the scene from blunt force trauma. Capps fled the scene on foot but was arrested the same day and initially charged with first-degree manslaughter, DUII, reckless driving, and failure to perform the duties of a driver.
A Lane County jury convicted him on all counts in October 2019, but the manslaughter conviction was later vacated in 2020 following an Oregon Supreme Court ruling on non-unanimous jury verdicts. Capps then pleaded guilty to criminally negligent homicide, received credit for approximately 2.5 years served, and agreed to the permanent revocation of his driver's license.
While awaiting trial on the 2017 crash charges in 2018, Capps was arrested again for DUII and reckless driving, and he was later convicted on both counts.
Capps is currently being held in the Lane County Jail pending further court proceedings. All individuals are presumed innocent until proven guilty in a court of law.
